Legal Aid Services at Fahrenheit Law
We are among the few law firms in London offering legal aid in specific circumstances within immigration law, family law, and criminal law. Legal aid is government funding designed to help cover the costs of legal advice and representation in a court or tribunal. Eligibility for legal aid is determined by the Legal Aid Agency based on your financial situation and the merits of your case. We will assess your eligibility for legal aid after your initial inquiry, but please note that receiving state benefits or having a low income does not automatically qualify you for legal aid.
Our Legal Aid Services Include:
- Family Law
- Criminal Law
Our legal aid services are available only in certain areas of England and depend on the specifics of your case.
Legal Aid for Family Cases
Legal aid in family law matters is divided into two categories: Public Law and Private Law.
Public Law Cases: These usually involve local authority interventions, such as care proceedings (Care Orders). Legal aid is generally granted automatically, regardless of financial circumstances.
Private Law Cases: These typically involve disputes within families, such as between partners and parents. Legal aid is available if there is evidence of domestic abuse from an ‘associated person.’ These cases often address separation, divorce, financial remedies involving children, and child arrangements.
Legal Aid for Criminal Cases
If you are under arrest, you are automatically entitled to receive legal advice from a Duty Solicitor. If charged with a criminal offense, your access to legal aid depends on the type of crime and your financial situation. Cases heard in the Crown Court automatically qualify for legal aid, although you may need to contribute to the fees based on your financial circumstances. Entitlement to legal aid in criminal cases is assessed individually.
Proof of Income for Legal Aid
To apply for legal aid, you may need to prove that you cannot afford legal services yourself. Eligibility is possible if you have a low income, no savings, or savings below £8,000.
You may qualify for legal aid if you receive:
- Universal Credit
- Income Support
- Job Seeker’s Allowance (JSA)
- Income-related Employment and Support Allowance (ESA)
- State pension
If your monthly income before tax is below £2,657, you may still be eligible. Required documents to confirm your income include:
- Bank statements
- Wage slips
- Student grant/loan letter
- Pension statements
- Tenancy/mortgage agreement
- Tax credit awards
- Letter from NASS or local authority stating asylum support (for immigration cases only)
These documents are not needed for applications related to care proceedings.
