Child Abduction Solicitors
Expert Child Abduction Solicitors for Complex Family Situations
When a relationship breaks down beyond repair and one parent wishes to return to their country of origin with the child, or has already done so, a child abduction solicitor can help. At Fahrenheit Law, our experienced child abduction solicitors can guide you through these stressful and complex situations.
Understanding Child Abduction
If there is a Court order stating that a child lives with one parent and spends time with the other, taking the child out of the country for more than four weeks without the other parent’s permission can be considered child abduction.
At Fahrenheit Law, we represent parents on both sides of these disputes, striving for positive outcomes as the number of child abduction cases continues to rise. Seeking legal permission to remove a child from the country in advance can help avoid the distress of child abduction proceedings.
Early Legal Advice to Minimize Stress
Do I Need a Child Abduction Solicitor?
Child abduction occurs when a child is taken out of the country without the explicit consent of both parents. This applies even to holidays if one parent does not consent. The only exception is when the parent with whom the child lives (as confirmed by a formal Court order) takes the child out of the country for a holiday lasting no more than one month before returning to the UK.
Under the 1980 Hague Convention on the Civil Aspects of International Child Abduction, being found Guilty of child abduction can result in severe penalties, including fines and imprisonment. Therefore, seeking advice from a child abduction solicitor before leaving the country with your child is crucial.
How Can a Child Abduction Solicitor Help Me?
If you are facing a situation where one parent wishes to return to their country of origin with the child or has already done so, a child abduction solicitor can assist by:
- Opening a channel for mediation between the parents to resolve the issue amicably.
- Advising on the legal implications of leaving the UK with the child without the other parent’s consent.
- Helping to seek a court order to prevent the child from leaving the UK.
- Gaining a Prohibited Steps Order in Court to pre-empt potential child abduction.
- Applying for a court order granting permission to leave the country for a specified period.

Child Abduction FAQs
What do I do if my child has been abducted?
Seek immediate assistance from the police and legal advice to apply for the safe return of your child. Time is of the essence, so do not delay in seeking help.
Can I prevent child abduction?
If you fear potential child abduction, consider applying for a Prohibited Steps Order (PSO) through the court. This can prevent the other parent from taking the child out of the country without permission. Legal aid may be available if you meet the criteria under regulations 33 and 34 of LASPO. If legal aid is not available, we offer fixed fee/private rates.
How can I legally move abroad with my child?
You need the consent of any person with parental responsibility, typically your ex-partner. If consent is not given, you must apply to the Court for permission to relocate.
How can I fund my International Child Abduction case?
Legal aid may be available for cases involving child protection and abduction, subject to means and merits assessments. Unlike PSO applications, you do not need “gateway evidence” for international child abduction cases. Contact us to discuss your eligibility for legal aid.
